Last month, a federal district court in Texas ruled that the DACA program was illegal. The state of Texas had filed a lawsuit against the federal government to try to stop the program.
The court has directed USCIS to continue accepting and approving applications to renew DACA, but to pause any decision making on initial DACA applications.
Thus, individuals who currently have DACA are eligible to renew their status and work authorization. However, those with first time applications will have to wait to see what happens next. Those cases are on hold for now. USCIS will continue accepting new initial applications, but those cases will be on hold as well.
The Biden administration has stated that the government intends to appeal that decision to the Fifth Circuit Court of Appeals. Stay tuned for any additional news.
