The status of DACA has changed very little in the years since several states filed a lawsuit in Texas to attempt to end DACA almost five years ago.  The most recent developments are from earlier this year in January, when the U.S. District Court responsible for the case and the Fifth Circuit Court of Appeals ruled that certain parts of the Biden administration rules issued for DACA were unlawful.  The case remains ongoing.

However, the Court of Appeals limited the application of this ruling to residents of Texas. It also permits the federal government to classify DACA holders as a low priority for removal, and allows them to not be removed.

USCIS is still accepting and renewing DACA applications for current DACA holders, including residents of Texas.  The review and approval of new initial applications is still on hold for now.   However, if the ruling stands, residents of Texas may no longer be able to renew their DACA or get work authorization in the future.
